Based on this one can conclude that the 7% nationality rule is a veiled effort to limit Indian and Chinese immigrants specifically. Does this not amount to discrimination by nationality ? In addition we as legal immigrants are taxed without any representation. Taxation without representation was the reason the US was created in the first place.
US history is full of examples where discrimination existed in one form or another and these discriminations were sucessfully challenged. A few examples are women's voting rights, minority voting rights and gerrymandering. These are good examples to study where the affected people had no legal voice to begin with.
The civil rights movement is a recent example. There were existing laws that limited people from voting based on their literacy levels in the southern states. The literacy requirement for voting was really a thinly veiled attempt to limit voting rights of african americans for as long as possible. The civil rights movement was about changing these artificial laws to give voting rights to people who legally had no voice.

You don't need to be a lawyer to speak up for your hardships as a law abiding resident. This country has tremendous protections for people living here which is what makes it great. We as an immigrant community need to build our awareness of US history and government if we expect things to change.

One of my friends came to US in 2002 applied for GC with PD of 2005 under EB3....looking at the situation he went back to India starting of Feb 2007...came back to US as Senior Project Manager [Virtual designation] he still does a developer work....applied for GC under EB1 in Aug 2008.....March 2009 he has got his GC.....

with current new fraud mantra EB1 will never spill over to EB2....soon EB1 for desis will have priority dates......

Recently, I did some calculations on EB1 & EB spillover to EB2 India/China for FY 2010. Here are points I considered
* Average Consular processing numbers for EB1 & EB2 / year are based on historic data from 1998 to 2008. (Data is available on DHS site)
* All ROW EB1 & EB2 applications from following categories will be approved before spill over happens
o consular processing (EB1 & EB2)
o ROW (EB1 & EB2) + Mexico + Philippines
* most applications for India / China EB2 from 2004 and prior are approved except few as mentioned on CIS report.
* Even if there are EB2 ROW I140 applications are pending, they may not be more than few thousands (based historic EB2 usage from EB2 ROW). Based on economic conditions, I assumed 5000 new I485 applications after approval of I140.

You might want to read this warning to yourself. I am not a Muslim myself, but solely pointing to the obscureness of the system. Even Kamal Hassan payed a price for his name, it's high time this changes, and this routine harrasment is very comparable to the H1B experience at POE.
I dont see any Harashment...They are not beating you. Just its extra verification. If you dont like that you are more than welcome not to come here. Everyday hundereds of people going this process and no one is crying foul and why only this time.?

I applied for EAD paying old fees in Jul 2007, and I renewed with new fees this year in Jun 2008, would like know if I need to pay renewal fees again when I renew my EAD in Jun 2009.

One possible argument someone can make is , if there isn't a per country limit on H1Bs, why should there be one on GCs?
We can have a lawsuit saying, cap both visa types or cap none.
If ever this law suit come before a judge, we can potentially win by creating a list of all the lost oppurtunities, lost time and money etc, basically building a human story around the restriction.
Other than that, I don't think per country qouta violates the constitution.
Anyways, I am enjoying this thread, very logical arguments in each reply.

the cycle for visa exhaustion has to happen before USCIS triggers action....its just not how many applications showed up on their door...and one(including me) should not feel toooo bad if we are not able to submit application becasue the visa numbers were exhausted. More painful will be if it is only based on applications received and mine went in a little later than others. lot of hard works has gone into prepraing this application. I would hire my attorney to put a suit against himself...

This could be due to simple processing issues :
Filling issues (the application was filled in wrong category)
REF (delayed response to RFE)
Name-check (delayed namecheck)
Other technical issues
Medical condition
Spouse of EB2 India/China where the application is filed under wrong charageblity.
If you see the number of application pending in EB2 ROW for 2007 and 2008 they are huge compared to previous years somewhere in hundereds which can mean having the above said issues. What if this country wants to ensure diversity to its social fabric?? How do they go about doing that?

I agree with you 100%, this change was made by Congress in attempt to reduce the backlog.
Think about it in terms of Congress, it was under a lot of pressure from high skilled workers and from companies like Google and Bill gates who argued for more number of visas. No offense to any EB3 category, but we all know, EB2 are the ones which have earned a higher skilled education from this country.
(Now please don't start any debates on EB2 or EB3, I didn't make any distinctions and it has no relevance.)
For Congress to somehow act, they made the change in movement of visa numbers, and geared more towards EB1/EB2, to reduce the backlog among EB2 category. This will eventually lead to roll over of visa numbers from EB2 to EB3.
Advantage? High skilled workers who have attained a Masters degree from
U.S., now will see a reduce in backlog.
This recent change in the flow of visa numbers, acknowledges all these problems. We all know, who ever takes over the next presidential elections, will not issue something right away, it will take a few months.
This change buys time and greatly reduces the backlog among EB2, eventually for Eb3 as well. The new process makes much more sense and I don't think this change will revert to its original movement (back to vertical flow)

Thanks for the brilliant idea, but I have a question about the draft. Is it really necessary to mention that 20% downpayment clause in there? I am a non-IT (manufacturing) EB3 applicant making half the salary you mentioned in the draft, and I bought a house with a 3% downpayment on a FHA loan. However, I have an excellent credit and I don't foresee myself in a foreclosure situation in the near future. I dont know if there are many GC applicant with my profile, but aren't we helping the housing market by buying a house?
Anyway, I will support every initiative that has the remotest possibility to remove one person in line ahead of me.

By remembering July, 2007 fiasco, I see an opportunity to build a lobby here in favor of legal immigrants (H1B, waiting for GC etc.)which will help all.
Act now, by mailing and talking to your employer about this memorandum if working with consulting company (doesn�t matter working with direct client or not, has EAD or not, GC priority is close or far) because employer is worst affected, they will of course will engage the attorneys. Attorneys are also affected with memorandum. This will help to build a big lobby here (remember July, 2007 fiasco) . Then, joining of IV members will help in result of BIG BIG BIG lobby.

Indira Gandhi.. we(at least some people) thought it was because of bullets and on spot.
But Madam Saino could not make up her mind whether to take her second mother(that's what she says Indira Gandhi is to her) to close by AIIMS or far away Lohia .when the team was going to AIIMS which was quite natural because of the distance Saino insisted on going to Lohia which had contingency protocol set up.After reaching Lohia suddenly she changed mind to go to AIIMS thus wasting 24 valuable min.So her second mother died of loss of blood.
One more thing ,it was also said that Indira' security arrangement was changed just 1 hour before that day's call which is unusual .
Also in the Saino's biography commissioned by the family it was written that Indira Gandhi had affair with two men.
Rajiv Gandhi- LTTE -reason they didn't like Indian forces in Srilanka.
LTTE has presence in Italy and other areas of Europe.
Priyanka/Rahul don't let anything in Rajiv's case go anywhere saying they are forgiving the culprits as though it is just family affair when actually Rajiv was country's ex-PM and it is national affair and not family affair to investigate/forgive.

I think we can make some very credible and good arguments for ourselves.
a) The changing demographics require an increased level of immigration. It is upto this country to decide if it wants semi-skilled immigrants (Indian cooks and gardeners) and their siblings/parents, or high-skilled immigrants.
Just read this in the morning.
The Center for Immigration Studies (CIS) estimates that in 2002 illegal alien households imposed costs of $26 billion on the federal government and paid $16 billion in federal taxes, creating an annual net fiscal deficit of $10.4 billion at the federal level, or $2,700 per household.
Among the largest costs, were Medicaid ($2.5 billion); treatment for the uninsured ($2.2 billion); food assistance programs such as food stamps, WIC, and free school lunches ($1.9 billion); the federal prison/court systems ($1.6 billion); and federal aid to schools ($1.4 billion).
If illegal aliens were legalized and began to pay taxes and use services like households headed by legal immigrants with the same education levels, CIS estimates the annual net fiscal deficit would increase to $29 billion, or $7,700, per household.
The primary reason illegal aliens create a fiscal deficit is that an estimated 60 percent lack a high school degree and another 20 percent have no education beyond high school. The fiscal drain is not due to their legal status or unwillingness to work.
Illegal alines with little education are a significant fiscal drain, but less-educated immigrants who are legal residents are a much larger fiscal problem because they are eligible for many more programs.
Many of the costs associated with illegal aliens are due to their US-born children who have American citizenship. Thus, barring illegal aliens themselves from federal programs will have little impact on costs.
Focusing just on Social Security and Medicare, CIS estimates that illegal households create a combined net benefit for these two programs in excess of $7 billion a year. However, they create a net deficit of $17 billion in the rest of the budget, for a total net federal cost of $10 billion.
